The judiciary affirmed the right of all Kyiv residents to freely enjoy the Dnipro embankment, which had been unlawfully claimed by residents of a luxury housing complex. The Supreme Court agreed with the arguments of the Kyiv City Prosecutor's Office and canceled the private ownership of hydrotechnical structures in the Berkovshchyna area, located within the protective coastal strip of the Dnipro River, covering over 2,300 square meters.
This embankment is situated near the residential complex at 14 Dnipro Embankment Street, in the Darnytsia district. The owners of the hydrotechnical structures had attempted to restrict access to the river for individuals who do not reside in the complex.
The hydrotechnical structures, designed as an embankment nearly 500 meters long, serve to protect against erosion. In 2020, a private company registered ownership rights to them. However, these structures are located on a communal land plot of over 3.1 hectares, valued at over 67 million UAH. The prosecutor emphasized that registering private ownership of these structures would result in the loss of community land and create barriers to free access to the Dnipro River.
The Supreme Court concurred that ownership rights to hydrotechnical structures cannot be registered by private individuals.
