The new draft of Ukraine's Labor Code aims to introduce innovative work formats such as remote work, home-based work, and flexible hours. Deputy Minister of Economy Daria Marchak stated that annual paid leave is set to increase to 28 days, aligning with EU standards.
The number of types of employment contracts will rise from six to nine.
Remote work is defined as a distinct type of employment contract that requires mutual agreement between employee and employer.
This work format may involve a combination of office and remote work, for example, two days in the office and three days at home, which will be outlined in the employment contract.
Additionally, the code prioritizes remote work for certain categories of employees such as pregnant women or those raising children under one and a half years. Employees facing harassment or discrimination may temporarily switch to remote work as a protective measure.
The new code also intends to eliminate outdated restrictions, modernizing labor legislation to meet current needs.
For instance, existing laws limit night work for women with young children, but the new code will remove such restrictions.
Among other key innovations, the code strengthens vacation guarantees, as current legislation only provides for 24 days, whereas European norms require 28.
After the new Labor Code is approved, employers will not need to re-sign contracts, although if employment relationships are not formally documented, they will have one year to rectify this.
On January 7, 2026, the government approved the draft of the new Labor Code, which will take effect following approval by the Verkhovna Rada.
