New Legislative Changes for Asset Management

On July 27, President Volodymyr Zelensky signed bill 12374-d, which introduces significant changes to the legislation concerning the National Agency for Detection and Management of Assets obtained from corruption-related activities.

The bill No. 4503-IX has been returned to parliament with the president's signature. The document is available on the official parliament website.

Earlier, on February 12, the Ukrainian Parliament supported this bill in its first reading, aiming to eliminate gaps and corruption risks in the operations of ARMA.

According to the explanatory note, the adoption of this law aims to create more effective conditions for managing seized assets and to rectify institutional shortcomings that hinder ARMA from performing its functions effectively.

Based on the decision of the Accounting Chamber dated December 25, 2024, the results of ARMA's work do not meet expectations regarding the introduction of transparent asset management mechanisms.

Lawmakers propose to involve professional managers, such as arbitration managers and private executors, in asset management. There are also plans to automate the process of selecting a manager.

Moreover, it is suggested to transfer assets valued at over 200 minimum wage sizes into ARMA's management, provided that their management is economically justified.

Among other innovations, the bill proposes to introduce a transparent selection procedure for the head of ARMA and to initiate an independent evaluation of the agency's effectiveness.
